While there are over 25 different types of license violations under the New York State Vehicle and Traffic Law, most license violation tickets issued in New York are for either VTL 509.1, Driving Without a License, VTL 511.1, Aggravated Unlicensed Operation in the 3rd Degree, often referred to Driving with a Suspended License, and VTL 511.2A  Aggravated Unlicensed Operation in the 2nd Degree.

While driving without a license (VTL 509.1) is a traffic infraction, not a misdemeanor, there is a growing trend in a number of courts, such as the Nassau County Traffic and Parking Violations Agency (Nassau County TVA) and at the Suffolk County Traffic and Parking Violations Agency (SCTPVA), to seek incarceration for those convicted of driving without a license with a history of such convictions. Consequently if you have been charged with driving without a license in New York you should consult with a New York Traffic Attorney.

Tickets issued for Aggravated Unlicensed Operation in the 3rd Degree, VTL 511.1 and Aggravated Unlicensed Operation in the 2nd Degree, VTL 511.2a  are both misdemeanors, a conviction to which, will result in a criminal record. In fact a conviction for Aggravated Unlicensed Operation in the 2nd Degree, VTL 511.2a requires by law, a mandatory sentence of either jail or probation, or both. Consequently if you have been charged with either VTL 511.a or VTL 511.2a you should consult with an attorney.
